By joining one of our affiliate programs you will have access to links and creatives to promote all or our stores, both present and future.

Term of the Agreements: The term of this Agreement will begin upon our acceptance of your Affiliate application and will end when terminated by either party. Either you or we may terminate this Agreement at any time, with or without cause, by giving the other party written notice of termination. You are only eligible to earn referral fees on sales occurring during the term.

Termination: If an affiliate is terminated for reasons other than breaking the terms of this agreement, Perfect Presence will notify them 7 days prior to the termination and all commissions still owed, regardless of whether the affiliate has reached the minimum payout or not, will be paid to that affiliate. If the affiliate was terminated for fraudulently promoting our stores and generated sales in a manner that is deemed fraudulent, the affiliates commissions will be forfeit.

Modification: We may modify any of the terms and conditions contained in this Agreement, at any time and in our sole discretion, by posting a change notice or a new agreement on this site. All affiliates will be notified by the e-mail address we have on file before the changes take place so they have proper warning.

Affiliate Agreement: Affiliates may not advertise any of the Perfect Presence Inc. stores with SPAM or any form of unsolicited e-mail. You may not link to a Perfect Presence store from an adult, hate, hacker, warez, defamatory, misleading, obscene or libelous web site. You may not do anything to misrepresent or damage Perfect Presence Inc. Any violation of these terms and your account will be deleted. It will be at Perfect Presence Inc.'s sole discretion as to whether or not a site has violated our terms and conditions. Perfect Presence reserves the right to refuse any application.

Commissions and Payments: Unless otherwise mentioned, Perfect Presence will pay a 15% commission to the affiliate for referring a customer to one of our stores. Commissions will be paid 30 days after the end of each month. You will receive a check from us as long as your commissions for that period are greater than $25.00. If the balance owed is less than $25 your balance will be carried over to the next month.

Chargebacks and Returns: Perfect Presence Inc has a 30 day return policy which is rarely taken advantage of. If, for whatever reason, a customer you refer sends back the product they ordered and requests a refund, the commission generated from that original sale will be deducted from your current balance. If an order turns out to be fraudulent, and a chargeback from the issuing bank occurs, the commission earned for that sale will be deducted from your balance.

Tracking: Perfect Presence Inc. does it's best to ensure our affiliates get credit for every sale they generate. We use a combination of cookies and IP tracking to keep track of who was referred by which affiliate. Perfect Presence Inc. will not be held liable for commissions that are not tracked due to instances beyond our control such as the manual deletion of cookies by the end user. Our cookies are set to expire in 90 days so you will continue to earn commissions for any sales generated by the customer you originally referred during that time.

Parasiteware/Theftware: Perfect Presence Inc. will not accept any company as an affiliate or partner that engages in predatory advertising.

Limitation of Liability: We will not be liable for indirect, special or consequential damages, or any loss of revenue, profits or data, arising in connection with this Agreement or the Program, even if we have been advised of the possibility of such damages. Further, our aggregate liability arising with respect to this Agreement and the Program will not exceed the total referral fees paid or payable to you under to this Agreement.

Independent Investigation: YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO ALL ITS TERMS AND CONDITIONS. YOU UNDERSTAND THAT WE MAY AT ANY TIME (DIRECTLY OR INDIRECTLY) SOLICIT CUSTOMER REFERRALS ON TERMS THAT MAY DIFFER FROM THOSE CONTAINED IN THIS AGREEMENT OR OPERATE WEB SITES THAT ARE SIMILAR TO OR COMPETE WITH YOUR WEB SITE. YOU HAVE INDEPENDENTLY EVALUATED THE DESIRABILITY OF PARTICIPATING IN THE PROGRAM AND ARE NOT RELYING ON ANY REPRESENTATION, GUARANTEE OR STATEMENT OTHER THAN AS SET FORTH IN THIS AGREEMENT.

Miscellaneous: This Agreement will be governed by the laws of the United States and the State of Pennsylvania, without reference to rules governing choice of laws. Any action relating to this Agreement must be brought in the federal or state courts located in Reading, Pennsylvania, and you irrevocably consent to the jurisdiction of such courts. You may not assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of and be enforceable against the parties and their respective successors and assigns. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.
